Municipal Ordinance
The Honorable Municipal Corporation of Roatán, Bay Islands in use of the powers and faculties that the Municipalities Law allows, DISCLOSES:
CONSIDERING: That the Constitution of the Republic establishes that it is a duty to participate in the promotion and preservation of personal and community health.
CONSIDERING: COVID-19 was declared a World Pandemic by the World Health Organization.
CONSIDERING: On March 14, 2020, COPECO declared a red alert for the 18 departments of Honduras, where it says that the Central Government and local governments are obliged to issue mandatory compliance provisions related to risk reduction.
CONSIDERING: Due to their geographical location, the Bay Islands, is isolated from the national territory and do not have the capacity in Health facilities to deal with an outbreak of COVID-19 CONSIDERING: It is the responsibility of the Municipal Corporation to take the necessary preventive measures in areas to safeguard the health and life of the population in the face of the threat of COVID-19.
CONSIDERING: The Municipal Law in its article 25, paragraph 15 empowers the Municipal Corporation to "DECLARE A STATE OF EMERGENCY OR PUBLIC CALAMITY IN ITS JURISDICTION, WHEN NECESSARY AND ORDERING THE SUITABLE MEASURES.
THEREFORE, IT ORDERS:
FIRST: DECLARE A STATE OF EMERGENCY OR PUBLIC CALAMITY IN ROATAN, for 14 days from Monday, March 16th at 5:59 PM, establishing the necessary measures.
SECOND: From Monday, March 16th at 5:59 PM, people will not be allowed to enter the municipality by air, sea or any other type of transport coming from the national or foreign territory.
THIRD: Any person who works in the educational system and under 17 years of age (school age) must remain in their homes and will not be able to move freely, except for a valuable reason.
FOURTH: Seafarers working in cargo companies must remain on board the boats and may not leave the ship or circulate within the municipality.
FIFTH: It is requested the cooperation of all the Port, Airport, Merchant Marine and Civil Aviation authorities.
SIXTH: The agglomerations of people of all kinds are prohibited, that exceed or congest public physical spaces. Public transportation shall observe and practice the hygienic decontamination actions of its units and report visibly ill passengers with respiratory conditions and refrain from transporting them together with other passengers.
SEVENTH: Health personnel enjoys a preference for attention in means of transportation, support businesses, related to their activities.
EIGHTH: Any person with flu symptoms, cough, the sore throat should be quarantined in their home and report their condition to the Secretary of Health.
NINTH: Businesses that alter prices due to the emergency will be fined and their operating permit will be suspended for 6 months and if the offense is repeated, it will be canceled.
TENTH: Only the Municipality of Roatán can modify or suspend these emergency measures. Given on Roatan, Bay Islands on the 15th day of March 2020.

ORDENANZA MUNICIPAL La Honorable Corporación Municipal de Roatán, Islas dela Bahía en uso de las atribuciones y facultades que la Ley de Municipalidades le permite, HACE SABER:
CONSIDERANDO: Que la Constitución de la Republica establece que es deber participar en la promoción y la preservación de la salud personal y de la comunidad.
CONSIDERANDO: Que el COVID-19 fue declarado Pandemia Mundial por la Organización Mundial de Salud.
CONSIDERANDO: Que el 14 de marzo de 2020, COPECO declaro alerta rojo para los 18 departamentos de Honduras en donde dice que el Gobierno Central y los gobiernos locales están obligados a emitir disposiciones de cumplimiento obligatorio relacionada con la reducción del riesgo.
CONSIDERANDO: Que las Islas de la Bahía por su ubicación geográfica esta aislado del territorio nacional y no cuenta con la capacidad en instalaciones de Salud para atender un brote de COVID-19
CONSIDERANDO: Que es responsabilidad de la Corporación Municipal tomar las medidas necesarias de prevención en aras de salvaguardar la salud y la vida de la población ante la amenaza de COVID-19.
CONSIDERANDO: Que la Ley de Municipalidades en su articulo 25, inciso 15 faculta a la Corporación Municipal “DECLARAR ESTADO DE EMERGENCIA O CALAMIDAD PUBLICA EN SU JURISDICCION, CUANDO FUERE NECESARIO Y ORDENAR LAS MEDIDAS CONVENIENTES.
POR LO TANTO, ORDENA:
PRIMERO: DECLARAR ESTADO DE EMERGENCIA O CALAMIDAD PUBLICA EN EL MUNICIPIO DE ROATAN, por un periodo de 14 días a partir del Lunes 16 de Marzo a las 5:59 PM estableciendo las medidas necesarias.
SEGUNDO: A partir del Lunes 16 de Marzo a las 5:59PM no se permitirá el ingreso de personas al Municipio vía transporte aéreo, marítimo o de ningún otro tipo proveniente del territorio nacional o del extranjero.
TERCERO: Toda persona que labora en el sistema educativo y menores de 17 anos (edad escolar) deberá permanecer en sus viviendas y no podrán circular libremente, salvo razón justificada.
CUARTO: Los marinos que trabajan en las empresas de carga deberán permanecer a bordo de los botes y no podrán salir del barco ni circular dentro del municipio.
QUINTO: Se pide la cooperación de todas las autoridades Portuarias, Aeroportuarias, Marina Mercante y Aeronáutica Civil
SEXTO: Se prohíben las aglomeraciones de personas de todo tipo, que superen o congestionen espacios físicos públicos. El transporte publico deberá observar y practicar las acciones higiénicas de descontaminación de sus unidades y reportar a pasajeros visiblemente enfermos de afecciones respiratorias y abstenerse de transportarlas junto con otros pasajeros.
SEPTIMO: El personal de salud goza de preferencia de atención en medios de transporte, negocios de apoyo, relacionado con sus actividades.
OCTAVO: Toda persona que presente síntomas de gripe, tos, dolor de garganta deberá permanecer en cuarentena en su vivienda y reportar su condición a la Secretaria de Salud.
NOVENO: A comercios que alteren precios debido a la emergencia se le multara y se le suspenderá su permiso de operación por 6 meses y al reincidente se le cancelará
DECIMO: Solo la Municipalidad de Roatán puede modificar o suspender estas medidas de emergencia.
